Share Unit

In Section 4 of Malaysia's Strata Titles Act 1985 (STA), a "share unit" refers to the specific number assigned to each individual parcel (unit) in a strata development, determining its owner's share of common property, maintenance charges, sinking fund contributions, and voting rights, calculated based on factors like parcel area and building features using a prescribed formula.

Charges

The amount of the Charges to be paid under subsections (1) and (2) shall be determined by the joint management body from time to time in proportion to the allocated share units of each parcel.

JMB

A Joint Management Body (JMB) is a temporary management body formed under Section 17 of the Strata Management Act 2013 (SMA). It is created to manage and maintain strata properties before the establishment of a Management Corporation (MC). The law ensures that there is always a governing entity responsible for maintaining the common property and handling financial matters even before strata titles are issued.

MC

A Management Corporation (MC) is the permanent body that takes over the duties of the JMB once individual strata titles have been issued. It is formed under Section 39 of the Strata Management Act (SMA) and consists entirely of the property owners.

In a unanimous judgment on 19 Nov 2025, the three-judge panel ruled that a Joint Management Body (JMB) is not empowered under the Strata Management Act (SMA) to impose multiple rates of charges on parcel owners.

Federal Court strikes out appeal bid for Management Corporation to impose Multiple rates

In a unanimous decision on Nov 25, the Federal Court bench, led by Federal Court judge Datuk Rhodzariah Bujang and flanked by Datuk Seri Vazeer Alam Mydin Meera and Datuk Mohd Nazlan Mohd Ghazali, had quashed PD1’s bid to appeal against the High Court and Court of Appeal (COA) decision which had not allowed PD1’s management corporation to impose the different rates of maintenance charges.
